Welcome to Beostar Health. These Terms of Use ("Terms") govern your access to and use of Beostar Health’s non-emergency medical transportation (NEMT) services across the United States. By booking, using, or accessing Beostar Health services, you agree to these Terms.

If you do not agree with any part of these Terms, you must not use our services.


1. ACCEPTANCE OF TERMS


By using Beostar Health’s services, you:

Confirm that you are at least 18 years old or have legal consent to book services.

Agree to comply with these Terms of Use and any applicable laws and regulations.

Understand that Beostar Health is not a medical provider and does not offer emergency services.



2. Description of Website

Beostar Health acts solely as a broker that connects users with independent transportation provider companies for non-emergency medical transportation. These providers operate their own fleets and drivers, which may be independent contractors or employees of their respective companies.

Beostar Health does not own, manage, operate, control, or employ any vehicles or drivers.

Services include, but are not limited to:


Doctor’s appointments

Dialysis and chemotherapy visits

Physical therapy

Hospital discharges

Other non-emergency medical transportation needs


3. ELIGIBILITY & BOOKING

Users must provide accurate pickup and drop-off details when scheduling rides.

Appointments should be scheduled at least 24 hours in advance for guaranteed availability.

Beostar Health reserves the right to deny or cancel a ride for any reason, including safety concerns, provider unavailability, or non-compliance with these Terms.

4. CANCELLATION & NO-SHOW POLICY/

We understand that plans may change, and we strive to offer a fair cancellation policy. Refunds or credits are issued based on the timing of the cancellation:

Cancellations made 48 hours or more before the scheduled pickup – Eligible for a 100% refund.

Cancellations made between 24 and 48 hours before the scheduled pickup – Eligible for a 75% refund or an 85% credit towards a future ride.

Cancellations made between 3 and 24 hours before the scheduled pickup – Eligible for a 50% refund or a 60% credit towards a future ride.

Cancellations made less than 3 hours before the scheduled pickupNo refund or credit will be issued.


No-Show Policy:

A no-show is classified as a client who is not present at the vehicle within 15 minutes of the scheduled pickup time. If the client is a no-show, no refund or credit will be issued.

5. FARES, BILLING & PAYMENTS

Fees are calculated based on distance, location, and service type.

Payment is due at the time of booking unless covered by Medicaid, insurance, or another third-party payer.

Any outstanding balances must be paid before scheduling future rides.

6. PASSENGER RESPONSIBILITIES

By using Beostar Health services, you agree to:


Be ready at the designated pickup time and location.

Treat drivers and staff with respect.

Follow all applicable safety guidelines and instructions.

Wear a seatbelt at all times during transportation.

Use proper mobility assistance devices if necessary.

Refrain from bringing illegal substances, weapons, or hazardous materials.

We reserve the right to refuse service to any individual for inappropriate behavior, safety risks, or violation of these Terms.

7. LIMITATION OF LIABILITY

Beostar Health provides transportation brokerage services but does not guarantee timely arrival or service fulfillment. By using our services, you agree that:

Beostar Health does not guarantee driver arrival times or completion of transportation. Delays, missed appointments, or cancellations due to traffic, weather, road closures, provider unavailability, or unforeseen circumstances are not our responsibility.

Passengers are responsible for planning ahead and scheduling rides accordingly.

Beostar Health, its shareholders, employees, affiliates, and partners shall not be liable for any injuries, accidents, or damages of any kind, including but not limited to:

Physical injuries (e.g., slips, falls, vehicle accidents).

Mental or emotional distress (e.g., stress, anxiety from delays or cancellations).

Verbal disputes or altercations with drivers, staff, or other passengers.

Monetary losses due to missed medical appointments or treatment delays.

Medical complications that arise from a delayed or missed ride.


If an accident, injury, or dispute arises while using Beostar Health’s services, all claims must be directed towards the transportation provider company, as Beostar Health acts solely as a broker and does not operate any vehicles or employ any drivers.

Passengers waive any right to hold Beostar Health responsible for any direct, indirect, incidental, or consequential damages.

By booking a ride, you acknowledge that Beostar Health assumes zero liability for any incidents or failures of service.

8. PRIVACY POLICY


Beostar Health collects personal data for booking, billing, and service improvement.

We do not sell, rent, or distribute personal data to third parties except as required by law.

9. CHANGES TO TERMS

Beostar Health reserves the right to modify these Terms at any time. Continued use of our services after any update constitutes acceptance of the revised Terms.

11. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes arising under these Terms or related to the use of Beostar Health’s services shall be resolved through binding arbitration in Davidson County, Tennessee.

By using Beostar Health’s services, you agree to waive any right to a trial by jury or participation in a class action lawsuit. Arbitration proceedings shall be conducted in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration body.

If any part of these Terms is deemed invalid or unenforceable under Tennessee law, the remainder of the Terms shall remain in full force and effect.

12. Payment and Broker Disclaimer

Beostar Health operates solely as a broker connecting clients with qualified healthcare providers for non-emergency medical transportation services. We will not charge any fees unless we successfully secure a provider to meet your transportation and care needs. In the event that we are unable to locate an appropriate provider, no charges will apply. By using our services, you acknowledge and agree that Beostar Health is acting exclusively as a broker and is not the direct provider of transportation services. Any agreements or contractual obligations for services rendered are between you and the selected provider.

13. Additional Fees and Non-Refundable Wait Times

For round-trip bookings, if the total service duration exceeds the time originally booked by the client, the driver reserves the right to conclude the service at the scheduled end time without issuing any refund for additional wait time. Furthermore, if the actual wait time extends beyond the duration disclosed at the time of booking, the transportation provider may impose additional fees to cover the extra time and associated costs. By confirming your booking, you acknowledge and agree that any extra wait time beyond what was initially communicated may result in extra charges or a forfeiture of any refund for the excess time.


By using Beostar Health, you acknowledge that you have read, understood, and agreed to these Terms.
